LINCOLN, Neb. -- Nebraska is one of six states filing a challenge to President Joe Biden's student loan forgiveness program.

The states made the filing in federal court on Thursday, asking the court for an immediate temporary restraining order pausing the program. The states said they sought immediate action because the Biden Administration has indicated it will start cancelling loan balances as early as next week.

"Just a few months ago, the Supreme Court warned federal agencies against 'asserting highly consequential power beyond what Congress could reasonably be understood to have granted' by statute," Nebraska Attorney General Doug Peterson's office said in a Thursday morning press release. "Yet the Biden Administration’s recently announced student loan cancellation program—the Mass Debt Cancellation—does precisely that."

Joining Nebraska in the filing are Arkansas, Missouri, Iowa, Kansas and South Carolina.
