A group billing itself as the nation’s oldest and largest Latino Civil Rights organization is demanding a federal investigation into the rare deadly police shooting of two Hispanics.

As we reported yesterday, the two officers involved have been cleared of any wrongdoing.

That according to police: 22 gunshots, the first fired into a crowd by the driver, one of two Hispanic men seen climbing into the car just moments earlier, armed with one and only one gun.

The next 21 shots, killing the two men, were fired by two off duty Omaha police officers.

Chief Todd Schmaderer, Omaha Police Department: “The officers were justified in that.”

The police officers: Captain Jay Levitt who has been with OPD for 25 years and officer Robert Soldo who's been with OPD 8 1/2 years.

The two were working security at the Extasis Night Club near 32nd and L Streets when a disturbance inside spilled outside.

The dead men identified as 26-year-old Fernando Rodriguez-Juarez and 28-year-old Jonathan Hernandez-Rosales, in the country illegally according to the chief.

Chief Schmaderer: “The immigration status of the deceased was archived only for background purposes. It is after the fact information and by no means can be used as justification for an officer to fire their weapon. It is also not an investigative consideration. The reality was we knew the media would ask so in the interest of transparency we provided it.”

In a wide-ranging complaint, the League of United Latin American Citizens did not specifically note that immigration status but did say, “The Omaha Police Department’s blatant attempt to vilify the character of the deceased Latinos is an affront to justice.” LULAC demanding a full federal investigation.

The chief is well aware of the shootings racial fall-out.

Chief Schmaderer: “I do think it’s going to be an impact. In this particular situation we want to do inroads and reach out and we’re willing to do so. Myself, I’ll be meeting with a group representing Latinos. And we will meet Monday and I’m going to give them an expanded explanation as to what took place here today and answer their questions fully.”
