One of the country’s largest automakers, a lesser known guardrail company and Sarpy County are urging a Nebraska judge to throw out a potentially damaging and expensive lawsuit. 

During a recent court hearing all three denied any responsibility for a June, 2019 crash that left four Gretna teen-age girls dead and a fifth girl injured.

Authorities blame the wreck, on alcohol and speeding—over 90 miles an hour.

The families of three of the girls are suing Ford, Sarpy County and Safety Guard insisting that the two-lane road— a stretch of Platteview Road near 180th street— and guardrail were defective.

In addition, the Ford Fusion the five were riding in did not have an “appropriate, functioning airbag system and airbags,” according to the families’ attorney, Mike Coyle.

Ford’s attorney told Sarpy County District Court Judge Michael Smith that the lawsuit lacked specifics.

The lawyer for the guardrail company said the suit provided no details explaining how the guardrail caused the crash.

Coyle responded that the guardrail was not constructed or installed properly, wasn’t long enough and improperly positioned.

Sarpy County’s attorney argued the lawsuit fails to spell out when the county failed to maintain and repair the road, but Coyle insisted, “This is a maintenance issue.”

The judge indicated he’ll decide if the lawsuit stays or goes in the next few weeks.
