Lt. Gov. Mike Foley is facing criticism for the second time in seven days.
 
And that's more criticism than he's faced in the last seven years as the number two man in state government behind Gov. Pete Ricketts.
 
The latest complaint finds Foley, a Republican, accused of playing fast and loose with campaign contributions.
 
State Sen. Adam Morfeld, a Lincoln Democrat, issuing a statement that Foley "illegally fundraised money... tens of thousands of dollars...as lieutenant governor...then renamed the committee where those funds were raised to benefit his (2022) campaign for state auditor." 
 
Morfeld citing state law which says, "The candidate for lieutenant governor shall not have a separate candidate committee" but in Foley's case the money would be included in the Ricketts fundraising operation. Morfeld says Foley should "disgorge" the money and remove it from the auditor's pot.
 
Foley, who has not been immediately available for comment, was criticized by Ricketts last week in a GOP family feud over the next governor.
 
When Foley endorsed GOP statehouse hopeful Charles Herbster, Ricketts—who is  backing NU Regent Jim Pillen for governor—said Foley's choice was "disappointing." 
 
Foley says he's convinced Herbster will be an excellent governor.
 
Ricketts has been telling anyone who will listen that Herbster will make a "horrible" chief executive.
